Terms of Servicethe rules/of using Broke Bot
Este texto legal está disponível em inglês e em francês.
These Terms govern your access to and use of the Broke Bot software, the website brokebot.app and the services that go with them. By using Broke Bot you agree to them. Where the English and another version differ, the English version applies.
1. Acceptance
By downloading, installing or using Broke Bot, or by using the website, you confirm that you have read these Terms and accept them. If you do not accept them, do not use the software or the website.
These Terms are an agreement between you and BKB ("we", "us").
2. Who may use Broke Bot
By using Broke Bot you confirm that:
- you are at least 13 years old, or the age of digital consent in your country if it is higher;
- you are legally able to enter into a contract;
- you are not in a country under international sanctions or trade embargo;
- your use of Broke Bot breaks no law that applies to you.
3. Account and license key
Using the software requires a Broke Bot account (a username and a password) and a valid license key. You alone are responsible for keeping your password and your key confidential.
A key belongs to one account and works on one computer at a time. If you change computer, contact us and we move it. Keys cannot be transferred to someone else unless we agree to it.
4. License
As long as you respect these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to install and use Broke Bot on your own computer, for the duration of your key, or without end date for a Lifetime key. This right is for personal, non-commercial use.
You may not:
- distribute, sublicense, sell, rent or hand over Broke Bot or your key to anyone;
- modify, decompile, disassemble or reverse engineer Broke Bot, or build something derived from it;
- use Broke Bot for anything illegal or unauthorised.
5. Your responsibilities
As a user, you agree that:
- you remain fully responsible for your Clash of Clans account and for everything Broke Bot does on it at your request;
- automation tools are against Supercell's Terms of Service, and using one can lead to penalties or a ban of your game account. We are not liable for that outcome;
- you will not try to get round the license check or the security of the software or of our servers;
- you will not use the software in a way that disrupts or damages our services.
6. Prohibited activities
The following are expressly forbidden:
- using Broke Bot with a hacked, modified or unofficial game client;
- reselling, redistributing or publicly sharing license keys or accounts;
- accessing our website or our servers with automated tools without our permission;
- anything that could damage, overload or impair our servers or networks;
- pretending to be one of our staff or representatives;
- harassing, threatening or abusing other users of our community.
7. Plans and payment
Broke Bot is sold as license keys: Monthly (30 days), Quarterly (90 days) and Lifetime, each as Pro or Ultimate. Payment is made by cryptocurrency transfer, in USDT on the TRON network or in Litecoin, from the payment page of the website.
- Prices are in US dollars and do not include network transaction fees, which you pay.
- Each order states an exact amount to send. Payment must be received in full, at that exact amount, before a key is delivered or an account extended.
- A cryptocurrency transfer is final. Send the exact amount, on the network shown, to the address displayed: a transfer sent to another address or on another network cannot be recovered by us.
- The duration of a key starts when the key is first activated.
- Nothing renews automatically. To keep access, you buy a new key.
- We may change prices at any time. A change does not affect keys already bought.
You are responsible for any tax or duty that applies to your purchase.
8. Refunds
Refunds are governed by our Refund Policy, which is part of these Terms.
9. Intellectual property
Broke Bot, its code, design, name, logo and interface belong to BKB. These Terms give you no ownership of them. You may not use the Broke Bot name or logo without our written permission.
Other names mentioned, such as Clash of Clans and Supercell, belong to their owners.
10. Automated decisions
Broke Bot recognises what is on the screen and decides by itself which base to attack, where to deploy and what to upgrade. It is provided as it is:
- we do not guarantee that its decisions are right, effective or profitable;
- it may not always choose the best target, and it may be detected;
- we are not responsible for what its actions cost you, including resources, trophies or penalties on your game account;
- we keep improving it, without any promise about future results or detection.
11. Availability and updates
The software must reach our servers to check your license, and it updates itself; updates are mandatory. We work to keep everything running, but we do not promise uninterrupted or error-free operation. A game or emulator update can make Broke Bot unusable until we adapt it.
We may change, suspend or stop Broke Bot, or any part of it, at any time, with or without notice.
12. Third parties
Broke Bot relies on or refers to services run by others, such as Discord for support and public blockchain services to check payments. Your use of them is governed by their own terms; we are not responsible for them.
Broke Bot is an independent project. It is not affiliated with, endorsed by or sponsored by Supercell. "Clash of Clans" is a trademark of Supercell Oy.
13. Limitation of liability
To the fullest extent the law allows, BKB is not liable for any indirect, incidental, special or consequential damage arising from your use of Broke Bot, including:
- loss of game progress, resources or access to an account;
- suspension or ban of a game account by Supercell;
- loss of profit, data or opportunity;
- damage caused by an interruption, a bug or an error.
Our total liability for any claim is limited to the amount you paid for the key the claim relates to. Some countries do not allow such limits; where that is the case, they apply only as far as the law permits.
14. No warranty
Broke Bot is provided "as is" and "as available", without warranty of any kind, express or implied. In particular we do not warrant that:
- it will meet your needs or expectations;
- it will run without interruption, delay or error;
- its results will be accurate or reliable;
- using it will not lead Supercell to act against your game account.
15. Indemnification
You agree to hold BKB and the moderators of our community harmless from any claim, loss or expense, including reasonable legal fees, that results from your use or misuse of Broke Bot, from your breach of these Terms, or from your breach of someone else's rights or of the law.
16. Suspension and termination
We may suspend or end your access to Broke Bot at any time, without notice, if you breach these Terms, if you act in a fraudulent, abusive or illegal way, if the law requires it, or if we stop the service.
When access ends, your key is revoked and you must stop using Broke Bot and remove it. The sections that by their nature should survive, such as intellectual property, liability and indemnification, continue to apply.
17. Changes to these Terms
We may update these Terms. The date at the top of the page shows the latest version. Continuing to use Broke Bot after a change means you accept the new version.
18. Disputes
Before any dispute, contact us: most problems are solved by a message.
If the consumer law of your country gives you rights that cannot be waived, nothing in these Terms takes them away.
19. Contact
